Experience or Arrogance
I had an agent, a pretty successful one actually, tell me that there is no water rights "west of the Mississippi"! I couldn't believe it. This guy sells real estate in Colorado! So, apparently on every deal he's ever done, water wasn't addressed. In his defense, I think he mainly sells homes in town with a tap. The deal I happen to be doing with him is a 40 acre parcel with a home. Additionally he said there are very few mineral rights west of the Mississippi. In Colorado, if you aren't checking on or researching the water rights or lack thereof, you are setting yourself up for, what could be a huge disappointment. In Colorado, for example of water rights have been determined or adjudicated, they can be sold or severed from the surface. Buyers need to know whether they own the water under the land or someone else does. Same with mineral rights, they can be severed at any time. A buyer needs to know before Haliburton comes pulling in. Wind rights are a fairly new concern. All need to be addressed. Ask your agent about his knowledge of water, minerals and wind. Double check with an expert. Protect yourself by making sure your Agent is thorough and knowledgable.
